23XI Racing and Front Row Motorsports have responded to NASCAR’s fiery 68-page appeal brief filed on Feb. 12. This filing is not directly related to NASCAR’s Mar. 5 countersuit but rather, the sanctioning bodies’ ongoing appeal of the crucial Dec. 18 injunction ruling.

On Feb. 12, NASCAR filed its appeal brief, claiming that the district court’s decision to allow the two teams to have their combined six Charters for the duration of the lawsuit “was fraught with errors, both legally and factually.” This brief focused heavily on the court’s decision to allow the teams charter benefits, and as the sport alleges, “forcing NASCAR to provide Plaintiffs with the benefits of a contract they rejected and NASCAR subsequently withdrew.”

In today’s filing, the teams addressed the accusations made by NASCAR and why they believe “The Injunction was narrowly tailored and fair. 23XI and FRM’s legal team also address NASCAR’s firey attitude, stating, “In their opening brief, defendants use overblown rhetoric and hyperbole to attack the district court’s reasoning.”

Background

Aside from this appeal, which is part of the injunction filed by the teams early on in the lawsuit, NASCAR has recently filed a countersuit against the teams and, specifically, 23XI Racing co-owner Curtis Polk. In the countersuit, NASCAR focuses on Polk, claiming he conducted a “plot to use collusive behavior to extract more favorable commercial terms from NASCAR in the Charter negotiations.”

The two teams initially sued NASCAR on antitrust grounds in October. They also motioned for a preliminary injunction that would allow them to race as Chartered teams throughout the lawsuit. Though they initially lost the injunction on Nov. 8, the teams refiled the motion and were granted their Charters on Dec. 18.
