Monday afternoon, 23XI Racing and Front Row Motorsports responded to NASCAR’s Aug. 19 filing that was in itself a response to a preliminary injunction motion filed by the two teams.

Thursday, 23XI Racing and FRM will have their preliminary Injunction hearing to maintain charter status for the remainder of the 2025 season.
This Injunction was filed after a Jun. 5 appeal ruling stripped the teams of their combined six charters, though NASCAR has maintained that since they did not sign the 2025 Charter Agreement last September, they never owned them in the first place.
Monday, in response to a filing made by NASCAR last week that not only detailed the sport’s plans on how they would go about selling these charters, alongside a claim that any new charter owners would need to know they had their charter by Oct. 1, the two teams claimed that if NASCAR were to transfer these charters prior to the December trail, they “will face the imminent destruction of their businesses regardless of how the jury rules.”
This is a similar claim to those made by the two in the past, but the tonal shift suggests urgency about the team’s operations. In response to this, fans online have discussed what the loss of these teams, and even 23XI co-owner Michael Jordan, could mean for the sport.
This filing followed a filing that same morning from NASCAR indicating their intent to “convey“ one of the charters to a new team, which makes an already eye-catching hearing this week all the more interesting.
NASCAR has already previously claimed there is interest from “motorsports companies racing in INDYCAR, Xfinity, and other series.” While these teams are unknown, there are a few standout organizations that could be potential buyers.
