What’s Happening?

With just over a month until 23XI Racing and NASCAR face off in court, the two sides’ legal representatives have agreed on terms for in-court conduct.

As of press time, the trial date for 23XI and FRM’s antitrust suit against NASCAR is set for December 1. Though the sides had two days of discussion on a settlement this past week, the likelihood of that happening is very slim.

As a trial date draws near, a filing today serves as a grim reminder of the impending court battle, with the two parties’ legal representatives having established boundaries on what can and cannot be discussed during the trial.

First, they have agreed to no personal attacks against one another. Of course, this is understandable, as the subject matter is business, and members of each legal team may have a history of facing one another in court.

Regarding that point, the two parties’ legal teams also agreed not to discuss or refer to past legal battles in which they had opposed one another.

Finally, and perhaps most noteworthy to NASCAR fans, the legal teams have agreed not to discuss Brian France’s exit from NASCAR, specifically the reason for his departure from the sport.

Brian, the heir apparent to his father, Bill France Jr., and grandfather, Bill France Sr., took over as NASCAR CEO in 2003, before exiting the sport in late 2018. Prior to leaving his post, France was arrested and charged with a DWI in August 2018.

Following this, Brian left his role, handing the position over to his uncle, Jim, who remains the CEO and Chairman of NASCAR. Fans have heard little from France since his exit, with a one-off appearance on The Dale Jr Download in 2022 serving as a bookend to his time in the sport.

Aside from his exit from the sport, Brian could likely come up in this case, as the Charter system, a major subject of interest in this legal battle, was introduced under his direction for the 2016 season.
