Following their court date today, new details have emerged explaining and expanding on the ongoing lawsuit between Legacy Motor Club and Rick Ware Racing.

Initially, the Apr. 1 lawsuit was thought to be based on an alleged miscommunicated date in the contract between the two teams. One team claimed the sale was for 2026, while the other claimed it was for 2027. Now, the issue at hand is not just about when LMC will have its charter transferred but also which charter they will be purchasing.
According to a report from Dustin Long of NBC Sports, Legacy Motor Club claims the agreement was to purchase Charter 27, currently used by RFK Racing’s No. 60 entry and Ryan Preece. However, RWR alleges they intended to sell LMC Charter 36, which they currently use for their No. 51 entry, not Charter 27.
This is because RWR is already in agreement with RFK Racing to lease RFK Charter 36 for their No. 60 next season. If RWR sold LMC Charter 36, it would have to be for the 2027 season, as RFK is likely to use the charter in 2026, and it appears RWR intends to race in 2026.
Charter 27, currently used by RFK, will be returned to RWR next season, as teams can only lease a charter to another team once every seven years. However, LMC wants Charter 27 because they want to race their third car next season, and according to Long’s report, RWR’s lawyer claims that doing so would put the Ford team out of business.
Background
Both Charter 27 and Charter 36 are two of the worst-performing charters on track. The charters, currently running under No. 60 and No. 51, were originally owned by Front Row Motorsports and HScott Motorsports. Their history also features back-marker owners and lessees like Premium Motorsports and TriStar Motorsports.
During today’s hearing, LMC was denied its motion for a preliminary injunction to prevent RWR from selling Charter 27. This young lawsuit has had its fair share of interesting moments, as in the initial Apr. 1 lawsuit filed by LMC, which claimed that RWR was in a poor financial spot.
Page 2 also alleges, “Strapped for cash, and unable to compete at a Cup Series level by its admission, RWR needed to sell one of its two Charters.” However, it seems equally likely that the record-breaking $45 million offer could have been enough for RWR to sell the charter no matter its financial status.
