What’s Happening?

More information has emerged in 23XI Racing and Front Row Motorsport’s request for financial information from other major professional sports leagues to support their ongoing lawsuit against NASCAR.

  • The NFL previously responded to the request on Mar. 31. But, according to Bob Pockrass of FOX Sports, the NFL also claims that the requested data is kept under such tight wraps that it is not even made available to their teams.
  • During late March and early April, 23XI Racing and Front Row Motorsport’s legal team filed multiple motions to compel compliance with subpoenas filed for revenue-sharing information from major sports leagues.
  • The goal of this pursuit was to “perform a yardstick comparison between the other major professional sports leagues (where competition is not precluded) and NASCAR.” Alongside the NFL, 23XI and FRM sent these subpoenas to the MLB, NBA, NHL, Formula One, and IndyCar.
  • In its initial Mar. 31 response, the NFL said the two teams did not have a “legitimate basis” to acquire this information. “To be clear, there is no legitimate basis for any assertion that the information sought has any direct connection to the substantive dispute between the parties.”
  • 23XI and FRM sued NASCAR in early October, claiming the sport violated antitrust laws by operating a monopoly over stock car racing. We have covered this lawsuit extensively via the timeline linked below.
