NASCAR’s Antitrust Lawsuit Officially Comes to An End

What’s Happening?

23XI Racing and Front Row Motorsports’ antitrust lawsuit filed against NASCAR in 2024 has officially been dismissed, bringing the drawn-out case and trial to an end just one day before the 2026 season kicks off.

Nearly two months ago, on December 11, NASCAR and two of its teams, Front Row Motorsports and 23XI Racing, settled an acrimonious antitrust lawsuit brought on by the teams in October 2024.

While it took well over 400 days, nine of which were part of a bitter court room back and forth between the two sides, not even two months since the two sides reached their settlement agreement, the suit has officially been dismissed by the District Court for the Western District of North Carolina.

As part of the settlement, NASCAR was to distribute new Charter Agreements to its 15 teams that own its 36 charters. These charters give teams automatic entry and a share of revenue with NASCAR for each charter owned.

The sport distributed these revised agreements the week of January 19, giving the team two weeks to sign and return the revised documents before the start of the season.

As of this week, 23XI Racing and FRM have returned the signed agreements to NASCAR, ending this monumental legal dispute.

The Settlement

The finer details of the settlement are unknown, though, within the hour of that final day in court, both sides were quick to acknowledge the addition of an evergreen clause to the Charter Agreement.

Prior to this settlement, should NASCAR choose to do so at the end of the agreement’s term, NASCAR could have revoked all teams’ charters and cancelled the system introduced in 2016.

Throughout the negotiations of the 2025 NASCAR Charter Agreement that occurred during the 2024 season, teams and NASCAR went back and forth, with many team owners asking NASCAR to add permanent status to the charters, meaning they would last forever.

In settling this lawsuit, some estimates claim that charter prices are set to skyrocket, with some even expecting them to reach upwards of $100 million following this landmark move by NASCAR.
