UPDATE: NASCAR to “Convey” Lawsuit Charter to New Team

What’s Happening?

In an interesting twist to its ongoing lawsuit with 23XI Racing and Front Motorsports, NASCAR says it plans to “convey” a charter to an unknown team.

UPDATE 5:47 PM: 23XI Racing and FRM filed a response to NASCAR’s response about the upcoming injunction hearing. In this filing, the teams claimed that if the court does not prevent NASCAR from selling or moving their charters before the trial date, they will “face the imminent destruction of their businesses regardless of how the jury rules.”

This comes just days before an Aug. 28 injunction hearing that, should the teams prevail, would return the two teams’ charters for the remainder of the season.

However, an Aug. 19 filing from NASCAR claimed that they have teams interested in acquiring a charter after a 30-day bidding process, but with the caveat that the newly chartered team will need to know that they will have a charter by Oct. 30 to prepare for the new season. Claiming that due to the late time frame created by this new injunction, “Interested parties will not have time to prepare for the 2026 Cup Series.”

It is unknown which team plans to obtain this charter, as this information is redacted from the filing. In past filings, NASCAR stated that there is “substantial interest in Charters from motorsports companies racing in INDYCAR, Xfinity, and other series.”

There is no indication of which charter would be at the center of the transfer.

Prior to the Jun. 5 ruling that stripped the two teams of their charters, each team owned three charters apiece. According to Bob Pockrass of FOX Sports, it will not be one of the charters each team acquired from Stewart-Haas Racing prior to the start of the 2025 season.

These charters, one (formerly used by SHR’s No. 4), used by FRM’s No. 4, and another (formerly used by SHR’s No. 10), used by 23XI’s No. 35, are considered “inactive” by NASCAR.

A now-overturned injunction issued in December required NASCAR to transfer these two charters, which the teams agreed to purchase prior to the lawsuit, but, as of July, NASCAR wants to “unwind” those transactions.
