What’s Happening?

Following a request from NASCAR, Judge Kenneth D. Bell is ordering that 23XI Racing/Front Row Motorsports and NASCAR participate in a settlement conference later this month.

  • Late Monday night, NASCAR asked the court for the parties to participate in a judicial settlement conference. The goal was for the parties to settle, having met under the same goal in August, although these talks of a settlement fell through.
  • Though they will have this judicial settlement conference, NASCAR is not getting everything they had requested on Monday. In their filing, NASCAR requested a “distinguished member of the bench” to facilitate the settlement talks.
  • Per today’s order, August’s Mediator, Jeffrey Mishkin, formerly of the NBA, will return to his role for this conference, as the teams had requested in a response filed on Monday night.
  • In a statement Wednesday afternoon, 23XI/FRM lawyer Jeffrey Kessler said, “We welcome Judge Bell’s decision to bring all parties together to engage in meaningful resolution. We remain open to a settlement that genuinely benefits the sport and its fans.”
  • If the two teams settle, it will bring an end to the antitrust lawsuit, filed by the teams over a year ago, and avoid what would surely be a bitter court battle in December.
