Judge Lays Out Timeline For Michael Jordan’s NASCAR Lawsuit

What’s Happening?

Baring a motion to dismiss from NASCAR, we now know the timeline for the antitrust lawsuit filed jointly by Michael Jordan’s 23XI Racing and Front Row Motorsports against NASCAR. If things go according to plan, the case could wrap up by late December 2025.

  • Following 23XI’s Dec. 16 response to NASCAR’s motion to dismiss, we now know the timeline for the ongoing 23XI and FRM antitrust case. The hearing for NASCAR’s motion to dismiss is scheduled for Jan. 8, and if the case goes forward, discovery could proceed throughout the year.
  • According to Bob Pockrass of Fox Sports, discovery, the period in which each party can gather the items and information needed to make their case, has a deadline of Sept. 19, 2025. The trial, should it go forward, is set for a Dec. 1 start date.
  • This will be more than one year after the teams filed their Oct. 2 lawsuit claiming that NASCAR has unequaled control over stock car racing. In order to file this lawsuit, the teams risked losing their four current Charters and their two future Charters, as the 2025 NASCAR Charter Agreement contains a release provision waiving NASCAR of antitrust claims.
  • Wednesday, a North Carolina judge ruled that 23XI and FRM would be allowed to sign a version of the Charter Agreement without the release provision. NASCAR will have to transfer their two charters from Stewart-Haas Racing. NASCAR plans to appeal this decision
