What’s Happening?

The U.S. Court of Appeals is upholding a 2022 judgment against former BK Racing owner Ron Devine. This judgment concerns the team’s bankruptcy proceedings from its closure in 2018.

  • This decision is an appeal of the Dec. 20, 2022, ruling against Devine. That ruling stated that Devine must pay $31 million to the trustee who manages BK Racing’s bankruptcy proceedings. The team’s bankruptcy was a major storyline of the 2018 NASCAR Cup Series season.
  • BK Racing shuttered its operation during the 2018 season. During the season, its assets and Charter were sold to Bob Jenkins’ Front Row Motorsports. FRM, which once again expanded this season, sold that Charter to Rick Ware Racing, which ultimately sold it to Spire Motorsports.
  • After opening in 2012, BK Racing entered 520 NASCAR Cup Series Races. The team fielded Toyotas and was sponsored by Burger King from 2012 to 2015, as Devine owned several Burger King franchises.
  • At its height, the team entered drivers like David Ragan, Corey LaJoie, and Matt DiBenedetto in races. The team also gave Hendrick Motorsports driver Alex Bowman his start in the NASCAR Cup Series.
  • Despite this mix of quality drivers, the team only managed three top-ten finishes in its existence.
