UPDATED: Dale Earnhardt Jr and NFL Star Lamar Jackson Battle for the No. 8

NASCAR Hall-of-Famer Dale Earnhardt Jr. is facing yet another battle for the right to use his stylized No. 8. This time, a legal challenge from NFL quarterback Lamar Jackson is the latest hurdle Earnhardt will have to overcome in his pursuit of ownership of the iconic number.

UPDATE 4/4 2:00 PM EST: Earnhardt released a statement claiming that JRM has fully acquired the Stylized (DEI) 8 and is moving on from the JRM 8 at the center of this controversy.

  • NFL star Lamar Jackson is claiming that Earnhart’s No. 8, yes, the number, is too similar to his own used by his ERA 8 brand. Despite some confusion, the three-time All-Pro quarterback of the Baltimore Ravens is going after the JR Motorsports No. 8, used from 2018 to 2024, not his recently acquired DEI Stylized No. 8, currently used by JRM in the Xfinity Series and Late Model Racing.
  • A recently filed Notice of Opposition with the U.S. Patent and Trademark Office is claiming that Earnhardt’s No. 8 is similar to Jackson’s trademark. The filing says, “highly similar in sound, appearance, connotation, and commercial impression to Opposer’s trademarks and brand so as to be likely to cause confusion, or cause mistake, or to deceive.”
  • A recently filed Notice of Opposition with the U.S. Patent and Trademark Office is claiming that Earnhardt’s No. 8 is similar to Jackson’s trademark.   • This news was shocking to fans, who learned about it last evening. Despite this shock, Jackson is currently taking on a similar battle against former NFL quarterback Troy Aikman. There is confusion about which No. 8 is being claimed, as most fans thought it to be the DEI No. 8 that Earnhardt finally acquired from his stepmother, Teresa Earnhardt, last year.
