What’s Happening?
Caesar Bacarella, co-owner of the Xfinity Series team Alpha Prime Racing, is suing Prime Hydration. Prime, a hydration and energy drink company, is known for its founders, YouTubers KSI and Logan Paul. The Southern District Court of Florida lawsuit claims that Prime has infringed on the Alpha Prime Trademark.
- Bacarella, co-owner alongside Tommy Joe Martins and driver for Alpha Prime Racing, owns Alpha Prime Supplements. The company’s website states, “Since our launch in January of 2021, we have focused on a premium line of sports nutrition supplements, protein-infused functional foods, ensuring quality products that perform for you.” Rather than Prime Supplements, Bacarella is listed as the plaintiff in the suit.
- The lawsuit claims that Prime Hydrations’ use of “Prime” creates confusion in the sports supplement market. The suit states, “The result of these confusingly similar products is actual and a likelihood of confusion as to the origin of the products, harming the reputation and goodwill of Bacarella’s brand.”
- Prime Hydration was founded in 2022. The promotion brought by KSI and Paul has gained brand popularity along with its heavy sponsorship of WWE and athletes such as NASCAR Cup Series Champion Kyle Larson. The suit asks Prime Hydration to cease selling or trademarking any products similarly named to the Alpha Prime and Prime Bites branding and award Bacarella financial damages.
