- On Aug. 7, NASCAR filed a motion for a show cause order, asking 23XI and FRM to prove why the court should not sanction them for “manufactured evidence” supplied to the court in November. In particular, NASCAR alleges that the team’s attorneys helped draft emails that raised issues with the potential for the teams to be uncharted.
- The judge denied this motion, saying, “NASCAR’s motion to show cause does not productively move this case forward. Instead, it appears intended to play to the court of public opinion and perhaps color the court’s perception of the opposing Parties and counsel (while at a minimum distracting them from their own efforts).”
- These allegations occurred during a period when the two teams were trying to prove that they could see irreparable harm should they be unchartered in 2025. This included claims that drivers like Tyler Reddick had an out in their contract should the team be unchartered.
- Ultimately, the two teams were granted charter status in December. However, NASCAR had this overturned on appeal on Jun. 5. As of press time, the two teams are entering their combined six full-time entries unchartered, meaning that if more than 40 cars are entered into a given race, they could miss the race.
