Wednesday, a North Carolina judge ruled that 23XI Racing and Front Row Motorsports will be granted their Injunction to race as Chartered teams in 2025. While the filling consists of several pages, there are several things worth knowing. Here are three things you need to know from this ruling.
- 23XI and FRM filed an antitrust lawsuit against NASCAR on Oct. 2. Shortly after filing, the team announced a plan to motion for a Preliminary Injunction.
- This Preliminary Injunction required the teams to prove that they would suffer Irreparable Harm if they raced without Charters. If they did so, they would be allowed to run as Chartered teams in 2025.
- The team lost the initial hearing for this Injunction on Nov. 8; however, it was re-filed with “new circumstances.” One of the team’s claims is that without their Charters, drivers and sponsors could leave 23XI and FRM.

When 23XI and FRM lawyer Jeffery Kessler claimed on Nov. 4 that drivers like Tyler Reddick could leave the 23XI, it was unknown who this included beyond Reddick. But, when the teams re-filed on Nov. 27, the “new circumstances” the team was facing were unknown due to heavy redactions.
However, following Wednesday’s ruling, the filing that accompanied it expanded on what drivers contacted the team about their status.
“As described above, since the Court denied the initial motion, 23XI’s top 2024 driver, Tyler Reddick, has given notice that the team is in breach of his driver contract, which will allow him to leave the team if the breach is not cured in 30 days (by December 18, 2024). Drivers Riley Herbst, Noah Gragson, Bubba Wallace and Corey Heim have similar contracts and/or have expressed their need for immediate resolution of the uncertainty surrounding the approaching racing season.” — Page 16
Not only did these drivers reach out, but Tyler Reddick informed the team that “it [23XI] had breached his Driver and Personal Services Agreement.” Whether Reddick or any driver planned to leave is unknown; however, this was a major aspect of the team’s victory on Wednesday.

Not only did Kessler claim drivers could leave the team prior to the Nov. 8 ruling, but valuable sponsorship could also depart the teams. The filing reveals that Love’s Travel Stops, which sponsors Todd Gilliland’s No. 34, emailed the team to question FRM’s “ability to meet contractual obligations next season.”
While Love’s is FRM’s largest sponsor in the Truck and Cup Series, 23XI also lost its key sponsor, Monster Energy. As page 8 states, “On November 23, 2024, 23XI received another email from Monster Energy, stating that it was reconsidering its entire relationship with 23XI.”
Monster also cited the fact that not only could Reddick miss the Daytona 500 without a Charter, but the team’s new car, driven by Riley Herbst, could miss it as well. The impact of losing a sponsor who supports two cars would be 23XI would have been massive.
In Wednesday’s ruling, the judge also told NASCAR it must supply the teams with their two Charters from Stewart-Haas Racing; perhaps Monster’s comments about Herbst helped the team’s case for getting these new Charters.

There is one more important and long-term story to break from Wednesday’s ruling. This story is that top Toyota prospect Corey Heim indeed has a contract with 23XI Racing.
While there was a rumor he had a future with the team, the filing confirmed this on page eight. It states, “Corey Heim also wrote that he needs answers “right away” so that he can ‘speak with other Cup race teams to see if any other opportunities would exist.’ “
This is significant as many fans questioned Heim’s re-signing with TRICON Garage prior to 2025. While TRICON is competitive in the Truck Series, Heim has proved he is ready for the next level. That promotion is something Toyota has failed to provide Heim with on a full-time basis. It now appears that his re-signing may have something to do with a potential future at 23XI.
While the details of his immediate contract with 23XI are unknown, it could perhaps include a part-time schedule with the team. Further evidence of this comes from him contacting the team, something he would more than likely not need to do if he weren’t racing with them in the immediate future.
