NASCAR filed a response to 23XI Racing and Front Row Motorsports’ latest motion for a preliminary injunction to maintain charter status during their ongoing lawsuit with NASCAR.

NASCAR’s response to the 23XI and FRM preliminary injunction maintains the same tone that it has expressed throughout the legal battle. It claims that NASCAR cannot be forced to do business with individuals it no longer wants to. The filing also endeavored to disprove some of the teams’ past claims.

On June 5, the United States Court of Appeals for the Fourth Circuit overturned a Dec. 18 injunction granting 23XI Racing and Front Row Motorsports charter status, including financial benefits and automatic race entry.

This new injunction to maintain charter status and prevent the future sale of their charters, which will be heard on Aug. 28, was filed after the court denied the teams a rehearing of the Jun. 5 ruling and is based on new evidence found in discovery.

Among the notable aspects mentioned in this latest filing, the sport confirmed that teams are allowed to compete in other series, such as the CARS Tour, something the teams claimed was proof of the sport’s monopoly. Furthermore, NASCAR claims that the new Charter agreement, which teams signed in late 2024, raised charter team payouts by 62%.

There is also a written deposition from NASCAR Commissioner Steve Phelps, in which he claims, much like the sport’s Jul. 14 filing, that there are already “multiple interested parties” for the two teams combined, six charters. To acquire these charters, there is a 30-day bidding process, and holding the charters could negatively affect potential new teams. Claiming that due to the late time frame created by an injunction, “Interested parties will not have time to prepare for the 2026 Cup Series.”
